NIVEE BRAZIL PRIVACY POLICY

Hello and welcome!

Important health notice: Nivee is a platform that connects you with licensed physiotherapists and occupational therapists. The app does not replace a medical appointment, does not issue diagnoses and does not provide automated clinical guidance. In case of acute pain, emergency signs or worsening symptoms, seek urgent medical care. Clinical decisions are the responsibility of the professional treating you.

At NIVEE, we value privacy and want to contribute to the protection of your personal data. For this reason, we present our Privacy Policy so that you know how we use your personal data.

What information will be covered in this Policy?

To facilitate your understanding of the information that will be covered in this Policy, we will clarify below the main terms that will be displayed:

Personal Data: information relating to an identified or identifiable natural person;

Database: a structured collection of personal data established in one or more locations in electronic or physical format;

Operator: a natural or legal person governed by public or private law who processes personal data on behalf of the controller;

Processing: any operation performed on personal data such as collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, elimination, evaluation or control of information, modification, communication, transfer, dissemination or extraction;

Consent: a free, informed and unequivocal expression by which the data subject agrees to the processing of their personal data for a specific purpose;

What does NIVEE do?

We primarily operate in the following business area:

Physiotherapy service platform

Our activity consists of providing an online platform that connects specialist physiotherapists in various areas (orthopedic, neurological, pelvic, respiratory, postpartum and post-operative plastic surgery, among others) for home care services.

How does NIVEE process data?

Like any company with an electronic address to carry out our activities, we need to collect and process some information that is considered personal data under the law. To keep you informed about how we process your data, we have prepared the following summary table with the main questions you may have.

What Personal Data of Registered Professionals Do We Collect?

In short, through login and password access, we may collect the following personal data:

Data collected on our website through completion by the professional:

Account Information: Professional data such as full name, email, identity document, CPF (Brazilian tax identification number), mobile phone number, full address, profile picture, and photo ID.

Service Information: Legal entity data such as CNPJ (Brazilian tax ID), headquarters, proof of registration status of the legal entity (if this is the chosen account method); area of ​​activity (namely physiotherapy and occupational therapy); specialties, resources used for care, service area (by distance or by neighborhood), days and hours of service, pre-selection, CREFITO registration number, CREFITO registration status, Home Care Assistance Certificate (CAD) and bank details.

Usage Information: cookies, IP address, browser type and device used, links clicked, date and time of access, and identifiers associated with your devices.

Publicly accessible data:

Data made publicly available by public or similar entities (e.g., Federal Revenue Service, Commercial Registries, etc.).

Data collected from partners:

Identifier matching information;

Geolocation data;

What Personal Patient Data Do We Collect?

In short, through login and password access, we may collect the following personal data:

Data collected on our website with the User's consent:

Account Information: User data such as full name, email, phone number, address, date of birth, CPF (Brazilian tax identification number, when applicable), and profile picture.

Usage Information: cookies, IP address, browser type and device used, links clicked, date and time of access, and identifiers associated with your devices.

Personal information: Medical history and evolution chart.

Data collected from partners:

What do we use Personal Data for?

In short, we use the personal data collected for purposes related to the provision of our services, that is, the data provided will be stored and used by NIVEE BRASIL to identify the User's profile, personalize the services offered, and allow the traceability of the user's actions in the system. We also use it for the following purposes:

Professionals: Patients' personal data will be shared with professionals to assist them; Partnerships and platform improvement: Personal data may be shared with contracted third parties or partners of NIVEE for use in platform maintenance tools, such as: Google Analytics, Hotjar, Microsoft Clarity; Communication with the user: NIVEE will use the user's email or telephone number to send information about their contract (confirmation of service contract), system updates and records, and improvements to our platform;

In addition to the forms described above, NIVEE may, at its sole discretion, use the User's personal data in the following ways: (i) updating registration; (ii) ensuring User security; (iii) responding to requests; (iv) information regarding changes to the Privacy Policies; (v) preparation of statistics regarding the use of the Site and applications, guaranteeing anonymity, including for the purpose of improving and understanding the profile of Users to improve services; (vi) improvement of interactivity tools between the software and the User, guaranteeing their anonymity; (vii) compliance with court orders; (viii) defense of NIVEE's rights against malicious Users in judicial or administrative proceedings; and (ix) diagnosing and fixing any problems in the NIVEE system.

NIVEE will use and share the Patient's sensitive personal data based on Article 11 of the General Data Protection Law, as it involves the provision of healthcare services for the benefit of the data subjects, through the intermediation of health consultations between the Patient and Healthcare Professionals.

NIVEE may process the personal data of children and adolescents if they are registered as dependents of the patient on the platform. The processing of personal data of children and adolescents must be carried out in their best interest, in accordance with the relevant legislation, and must be done with the specific and prominent consent given by at least one parent or legal guardian.

By refusing access to Cookies and/or other applicable monitoring for Usage Information, you prevent us from providing our Services in the best and most complete way possible for you.

With whom do we share Personal Data?

Personal data may be shared with several recipients, namely:

Data platforms: we use companies to store our data to improve the efficiency and speed of our software. These databases respect all security standards for the personal data of our professionals and clients, observing the provisions of the General Data Protection Law. Payment platforms: we use partner companies to process payments made for the contracting and use of our services and products. Identifier verification partners: to improve the efficiency of associating our identifiers with others, we may need to share the identifiers we assign to browsers through cookies with our partners. Public authorities or official bodies: to comply with legal obligations to which we are subject, we may need to share data with public authorities or official bodies upon request or express legal provision.

We emphasize that this sharing is necessary for payment processing, CRM, user monitoring for customer success, segmented research, commercial partnerships, and improving platform services.

How do we protect Personal Data?

At NIVEE, we implement all security measures within our reach to protect your personal data from unauthorized access and from accidental or unlawful destruction, loss, alteration, communication, or dissemination.

We have an internal data protection policy that applies to all those who process personal data on our behalf, and we have a robust incident response plan in case of any undesirable situation related to the data we process.

In addition, we have periodic processes for evaluating our privacy governance program and for discovering and addressing risks in our activities.

Finally, we are committed to training our employees on the importance of data protection to keep them updated on best market practices.

How long do we keep Personal Data?

NIVEE's retention of personal data adheres to the following guidelines:

Only the personal data strictly necessary for the purposes of the processing are kept in our database, that is, for the entire period necessary to comply with legal or regulatory obligations by NIVEE, such as (i) storage of registration personal data for 5 (five) years after the termination of the legal relationship; and (ii) storage of digital identification data for 6 (six) months (Article 14 of the Brazilian Civil Rights Framework for the Internet), among others. After that, the personal data will be duly and securely deleted or anonymized.

Notwithstanding the foregoing, we preserve the information necessary for compliance with legal and regulatory obligations or the exercise of our rights in administrative, judicial or arbitration proceedings.

What are the rights related to Personal Data?

We are proud to be a company that takes the rights of personal data subjects seriously. Therefore, we guarantee that the rights over your personal data provided for by law (Article 18 of Federal Law No. 13.709/2018) can be fully exercised, respecting the applicable limits.

We highlight the following rights that you can exercise:

Data access: anyone can request access to their personal data stored by us, as well as information about possible sharing with third parties.

Correction: If the personal data is incorrect, a correction or update request may be made.

Deletion: Data provided with consent may be deleted. However, even after a deletion request, some personal data may remain stored due to legal obligations or to protect our interests or those of our clients.

Objection: You can object to the processing of your personal data by NIVEE.

Attention: If the User objects to the processing of their personal data, even after agreeing to this Privacy Policy, they will be unable to use the services we offer.

Data portability: To enable you to exercise your right to data portability, we may provide you with a copy of your personal data in a commonly readable format.

NIVEE reserves the right to modify or amend this Privacy Policy at any time and for any reason. When amended, NIVEE will provide clear notices of the changes and will obtain the data subject's consent again when necessary, as well as republish this document with respect to personal information that does not require consent, notifying the data subject.
